House Rules and GTC

The House Rules serve the safety of everyone inside the facility. They apply to every person who enters the facility.

A.1 General

A.1.1 These House Rules apply to all users and visitors of the facility. The version in force at the time of the visit applies.

A.1.2 By entering the facility, every person agrees to these House Rules and undertakes to comply with them. Halevi exercises the right of domicile (Hausrecht) inside the facility.

A.1.3 Every user reports to reception before each activity.

A.1.4 Damage of any kind and any hazard identified must be reported to staff without delay.

A.1.5 Instructions given by staff (audible or visual) must be followed immediately at all times. Staff are entitled to inspect the firearms and types of ammunition used for shooting.

A.1.6 The shooting range must be left in a proper and clean condition. Cases and waste must be disposed of in the containers provided; waste separation must be observed. In case of non-compliance, the cleaning effort will be charged (C.13.4).

A.1.7 Current notices and information posted on the premises must be observed.

A.1.8 The facility is under video surveillance (C.14.3).

A.2 Authorisation to use the shooting ranges

A.2.1 Entering and using the shooting ranges is permitted for persons of full legal age (for exceptions see C.10.3), except for:

- persons without a valid firearms document (firearms possession certificate, Waffenbesitzkarte, or firearms carry permit, Waffenpass), except as an accompanying person under C.11.1, during Adventure Shooting, in courses and workshops supervised by Halevi, or by arrangement with the range management;

- persons who are subject to a weapons ban (Waffenverbot) or a provisional weapons ban;

- persons who are under the influence of alcohol, narcotics, medication or other impairing substances;

- persons who have been prohibited from using the facility by staff.

A.3 Restrictions and prohibitions

A.3.1 Bringing in and firing any weapons and ammunition prohibited under the applicable Weapons Act is forbidden. Tracer ammunition, incendiary and armour-piercing projectiles as well as muzzle-loading and black powder firearms are also not permitted.

A.3.2 A strict ban on smoking, alcohol and drugs applies. Eating, drinking and using the telephone are additionally prohibited in the static and the dynamic shooting range.

A.3.3 Any action that could ignite powder residue is prohibited. This applies in particular to open flames, flammable liquids and gases, pyrotechnic charges and articles, igniters and other explosive substances.

A.4 General safety rules in the shooting ranges

A.4.1 The shooting ranges may only be entered and used with shooting glasses and hearing protection. Anyone wearing prescription glasses does not need additional shooting glasses.

A.4.2 The shooting ranges may only be entered and left with unloaded firearms. Holders of a firearms carry permit (Waffenpass) and duty weapon carriers of an Austrian authority are exempt.

A.4.3 Firearms and ammunition belonging to others must not be touched without the owner’s express consent.

A.4.4 Everyone is responsible for their own firearm.

A.4.5 Firearms must always be regarded and treated as loaded.

A.4.6 Everyone must ensure that the safety of all persons and of the entire infrastructure is maintained. The required care in handling firearms must be observed without exception.

A.4.7 Before the door to the shooting range is opened, the user must confirm by visual inspection that it can be opened safely. Opening is permitted only during breaks in shooting.

A.4.8 Loaded firearms must not be handed over or put down. If a firearm has to be put down, it must be unloaded and made safe.

A.4.9 Firearms must be unloaded immediately after shooting has ended.

A.4.10 Firearms may only be placed or put down unloaded and, depending on the type of firearm, with the magazine removed or the cylinder swung out. The muzzle must point towards the backstop.

A.4.11 Cleaning, disassembling and repairing firearms is permitted only in the safety zone („Fummelzone“). A strict ban on ammunition applies in the safety zone. Handling firearms outside the designated areas is prohibited.

A.4.12 Loading, unloading, shooting, aiming and sighting exercises and any other handling of the firearm, whether loaded or unloaded, are permitted only in the direction of the target or the backstop. Under no circumstances may a firearm be pointed in any other direction or at people. The muzzle must be directed so that no one can be endangered or injured by an unintentional discharge.

A.4.13 Turning away from the backstop with a firearm in hand, whether loaded or unloaded, is prohibited.

A.4.14 Keep your finger off the trigger! The finger stays outside the trigger guard until immediately before the intended shot is fired.

A.4.15 In the event of a stoppage or other malfunction that the shooter cannot clear themselves, staff must be notified. The firearm must be unloaded with the muzzle pointing towards the backstop, or handled so that no one is endangered. In the event of malfunctions that require shooting to be stopped, the instructions of staff must be followed immediately.

A.5 Dynamic shooting range

A.5.1 Dynamic shooting (moving with a live firearm) is prohibited for individuals shooting on their own for safety reasons. Where there are more than two shooters, the group appoints a responsible and qualified supervisor. This supervisor supervises the shooting at all times, ensures that those present do not create avoidable hazards and comply with these House Rules, prohibits shooting and presence in the facility in case of danger, and determines the loading and unloading areas as well as the sequence of the exercise.

A.5.2 Targets may only be moved and positioned so that shots are fired towards the backstop. Mobile bullet traps are subject to charges and approval and are permitted only after a separate instruction has been signed.

A.5.3 The shortest distance from which shots may be fired at a target is 5 metres.

A.5.4 Only the designated targets may be engaged. Targets that have fallen over must not be shot at.

A.5.5 A shot may only be fired if no person is standing in front of the firing line, and therefore only ever by the person standing closest to the backstop. With experienced shooters and in the presence of a trainer, several shooters may shoot from one line at the same time. It must be kept in mind that shooters can be hit by cases ejected by the person next to them.

A.5.6 In the dynamic range, handguns are either fired from the shooting table (in which case the rules of the static shooting range apply) or stowed in a holster immediately after the shot. Walking around the dynamic hall with a handgun in hand is not permitted, because the barrel would inevitably not be pointing towards the backstop. Long guns may only be carried in the dynamic hall when fired empty and made safe, with the barrel pointing downwards or upwards.

A.5.7 Firing shot and slugs is permitted only after consultation with and instruction by Halevi.

A.6 Static shooting range

A.6.1 A maximum of 2 persons are permitted per firing point.

A.6.2 Handling the firearm is permitted only at the assigned firing point and, in an unloaded state, also in the safety zone („Fummelzone“). Firearms are taken out of their transport container only at the firing point and are stowed there again after shooting.

A.6.3 The barrel of every firearm must always point towards the backstop. Loading, unloading, shooting, aiming and sighting exercises and any other handling of the firearm are permitted only at the firing point and with the barrel pointing towards the backstop.

A.6.4 The partitions of the booths at the firing point are not bulletproof. Any danger to persons must be excluded.

A.6.5 Shooting is permitted only from a standing position and only at an angle that avoids floor, ceiling and wall hits.

A.6.6 Only ring targets may be engaged that are no larger than those available from Halevi.

A.6.7 Shooting must be slow and controlled (max. 1 shot per second). No combat shooting, no drawing from the holster, no magazine changes.

A.6.8 Long guns may only be fired at distances of at least 20 m. Firing shot and slugs is prohibited.

A.7 Krav Maga, self-defence and force-on-force training

A.7.1 Protective clothing must be worn during force-on-force training with non-lethal or marking ammunition. Protective goggles must be worn in the hall throughout the training, including during breaks, and must not be removed.

A.7.2 Every participant is responsible for putting on their protective equipment correctly. If the protective equipment slips during an exercise or no longer fits correctly, the exercise must be stopped immediately and staff must be notified.

A.7.3 C.10.5 (health) applies. If a participant feels unwell, training must be interrupted immediately and the trainer present must be informed.

A.7.4 Everyone must ensure that the safety of all persons and of the infrastructure is maintained during training. Intensity and volume of exercise must be monitored by each participant and adapted to their personal fitness level. Excessive force is prohibited.

A.7.5 Because of the risk of injury, wearing watches, jewellery and similar items is prohibited. Wearing prescription glasses is at the participant’s discretion; prescription glasses do not replace the protective goggles provided by Halevi during force-on-force training.

A.7.6 Instructions given by staff (audible or visual) must be followed immediately at all times.

A.7.7 Drinking water in closable containers, such as water bottles, is permitted. Glass bottles and drinks other than water are prohibited in the training rooms.

A.7.8 Participants use their own training clothing. It may become soiled or damaged during training (C.12.5).

A.8 Workshops without a firearms authorization and Adventure Shooting

A.8.1 This section applies to all offers in which participants handle firearms without holding a firearms authorisation of their own, in particular Adventure Shooting, workshops and corporate events. Shooting takes place exclusively under the direct supervision of an instructor; participants act only on the instructor’s instruction. Anyone who has not understood an instruction, or who is unsure, asks before acting.

A.8.2 Before the first exercise, every participant receives a safety briefing on the firearm. No firearm is taken over without this briefing.

A.8.3 Firearms and ammunition are issued exclusively by the instructor and are returned to the instructor after every exercise. Participants do not pick up a firearm themselves, do not put it down on their own initiative and do not pass it on to other participants. Loading is done only by the instructor or under the instructor’s direct guidance.

A.8.4 Only the person the instructor calls forward shoots. All other participants and accompanying persons stay in the designated area behind the firing line.

A.8.5 As long as a participant has a firearm in hand, they stay facing the backstop with the muzzle pointing towards the backstop. They do not turn around, do not point at anything with the firearm, and keep their finger outside the trigger guard until the instructor calls for the shot.

A.8.6 In the event of a malfunction of the firearm, such as a stoppage, the participant does not attempt to clear it themselves. The firearm stays pointed towards the backstop, the finger stays outside the trigger guard, and the instructor is called.

A.8.7 Ejected cases are hot, but harmless. If a case hits a participant, the firearm stays pointed towards the backstop; the case is removed only after the firearm has been safely put down or handed over. While shooting is in progress, no cases or cartridges are picked up from the floor.

A.8.8 Anyone who feels unwell or wishes to stop an exercise tells the instructor. The firearm is handed over safely first; participation can be ended at any time.

A.8.9 Photographs and video recordings are permitted where the instructor allows them, and never by a person holding a firearm. C.14.4 applies in addition.

A.9 Loan firearms, ammunition and equipment provided by Halevi

A.9.1 Loan firearms provided by Halevi are used only under the supervision of staff and only in the designated area.

A.9.2 Ammunition issued by Halevi may only be fired inside the facility. Taking ammunition away is prohibited. Persons holding a valid Austrian firearms authorisation are exempt.

A.9.3 Protective equipment and other loaned equipment must be handled with care and returned at the end of the session.

A.10 Sanctions

A.10.1 In the event of breaches of these House Rules, of danger to persons, or for other objectively justified reasons, in particular for safety reasons, staff may impose a temporary or permanent ban on use and entry, including without prior warning. The person concerned must leave the facility immediately.

A.10.2 If the reason for the ban lies in the person concerned, there is no claim to a refund of course or range fees or of other charges; the agreed fee remains payable in accordance with C.7.3.

PART B RISK NOTICE AND DISCLAIMER OF LIABILITY

B.1 Risk notice

B.1.1 Every participant is aware that handling firearms, close combat, force-on-force training and tactical training involve an increased risk to health and life. Even when the greatest care is taken, accidents resulting in serious injury, and in extreme cases in death, cannot be excluded.

B.2 Personal responsibility

B.2.1 Every participant shoots and trains on their own responsibility. Everyone is responsible for their own conduct, in particular for their handling of the firearm and for every shot they fire.

B.2.2 Halevi’s liability for its own fault and for the fault of its employees and vicarious agents is governed by C.12 and B.4.

B.3 Liability of the participant

B.3.1 Every participant is liable for damage to persons and property culpably caused by them in accordance with C.13, including the flat-rate charges for stray shots under C.13.2.

B.3.2 Every participant indemnifies and holds harmless Halevi, its employees and vicarious agents against all third-party claims arising from damage culpably caused by them in connection with shooting or training. This also applies to damage caused by accompanying persons shooting under their supervision, to the extent that the damage results from a breach of their duty of supervision.

B.4 Liability of Halevi

B.4.1 Halevi is liable for personal injury in accordance with statutory provisions, without limitation.

B.4.2 For damage to property and financial loss, Halevi is liable only in cases of intent or gross negligence. To that extent, every participant waives claims based on slight negligence against Halevi, its employees and vicarious agents.

B.4.3 C.12.4 and C.12.5 apply to damage caused by other users of the facility and to loss, theft or damage of items brought along (clothing, jewellery, money, valuables and the like).

B.5 Insurance

B.5.1 Halevi does not take out insurance for participants. Every participant is responsible for obtaining adequate insurance cover, in particular accident, health and personal liability insurance.

B.6 Declaration regarding weapons bans

B.6.1 Every participant declares truthfully that they are not subject to a weapons ban (Waffenverbot) or a provisional weapons ban. False statements entitle Halevi to exclude the participant immediately (C.8.4).

PART C GENERAL TERMS AND CONDITIONS

C.1 Provider

C.1.1 The provider of all services is Halevi Partner GmbH, Rothergasse 2, 1220 Vienna, Austria, company register number FN 502693 f, Commercial Court of Vienna, VAT identification number ATU75851106, e-mail office@halevipartner.com, telephone +43 676 4415252 (hereinafter „Halevi“).

C.2 Scope, structure and definitions

C.2.1 This document consists of Part A (House Rules), Part B (Risk Notice and Disclaimer of Liability), Part C (General Terms and Conditions) and Part D (Confirmation of the booking and participant declaration). All parts apply together.

C.2.2 These terms apply to all contracts between Halevi and its customers, whether the booking is made online, by e-mail, by telephone or on site. They also apply to every stay on the premises and in the rooms of the training centre at Rothergasse 2, 1220 Vienna (hereinafter the „facility“) and to sessions that Halevi conducts away from the facility.

C.2.3 „Customer“ means anyone who concludes a contract with Halevi, including where they book for other persons. „Participant“ means every person who uses a service provided by Halevi or who enters the facility, including accompanying persons. „Consumer“ and „entrepreneur“ are to be understood within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG). Provisions that apply only to entrepreneurs are marked as such.

C.2.4 Individual agreements, in particular in a written offer or in the booking confirmation, take precedence over these terms. The customer’s own terms and conditions apply only if Halevi agrees to them in writing.

C.2.5 References to persons in this document apply to all genders equally. The headings serve readability and do not limit the content of the provisions.

C.3 Services

C.3.1 Halevi operates an officially approved shooting range and a security training centre. The services offered include in particular:

- use of the static and the dynamic shooting range by holders of a firearms authorisation,

- shooting courses, shooting training and trainer sessions,

- self-defence and Krav Maga,

- force-on-force training with simulation weapons and marking ammunition,

- workshops, corporate events and team building,

- Adventure Shooting for persons without a firearms authorisation,

- vouchers for these services.

C.3.2 The content, duration, number of participants, requirements and price of each service are set out in the description on the website, in the online booking system, in the individual offer or in the booking confirmation.

C.4 Booking and conclusion of contract

C.4.1 Online booking. Using the online booking system linked on the website, the customer selects the service, the date and the number of participants. Before submitting, the customer can review and correct their entries and must accept these terms. By submitting, the customer makes a binding offer subject to payment. The contract is concluded upon the booking confirmation that Halevi sends to the e-mail address provided.

C.4.2 Enquiries. Enquiries via forms on the website, by e-mail or by telephone are non-binding. A contract is concluded only upon confirmation by Halevi by e-mail. If the confirmed date differs from the enquiry, the contract is concluded only once the customer confirms the changed date.

C.4.3 Halevi is not obliged to accept bookings or enquiries.

C.4.4 The customer and every participant provide true and complete information, in particular regarding name, date of birth, contact details and firearms documents, and notify any changes without delay. If the customer suspects that third parties are misusing their data, they inform Halevi without delay.

C.4.5 Group and corporate bookings. Anyone booking for several persons is Halevi’s contractual partner and owes the entire fee. They ensure that all participants are aware of these terms before the date, in particular of the participation requirements under C.10. Every participant signs in person on site (C.10.1).

C.4.6 The language of the contract is German. In the event of discrepancies between a translation and the German version, the German version prevails. These terms are available on the website at all times and can be saved and printed there.

C.5 No right of withdrawal for date-specific bookings

C.5.1 For contracts for services connected with leisure activities for which a specific date or period is agreed, there is no statutory right of withdrawal, including where the booking is made online, by e-mail or by telephone (Section 18(1)(10) of the Austrian Distance and Off-Premises Transactions Act, Fern- und Auswärtsgeschäfte-Gesetz, FAGG). Only the cancellation conditions under C.7 apply to such bookings.

C.5.2 If a consumer purchases a voucher by distance selling, for example by e-mail or telephone, for which no date has yet been fixed, they may withdraw from the contract within 14 days of the conclusion of the contract without giving reasons. Withdrawal may be declared informally, for example by e-mail to office@halevipartner.com. Halevi refunds amounts already paid within 14 days of receipt of the declaration of withdrawal.

C.6 Prices and payment

C.6.1 All prices are stated in euros and include statutory value added tax. The price stated in the booking confirmation or in the individual offer applies.

C.6.2 Services not included in the price, such as additional ammunition, loan firearms, targets or additional services on request, are charged separately at the prices notified before they are used.

C.6.3 Payment is made on site in cash or by card, or by bank transfer before the date if so agreed.

C.6.4 Halevi may request a deposit before the date. The deposit is credited against the fee. In the case of free cancellation under C.7.1 it is refunded; otherwise it is offset against the amount owed under C.7.

C.7 Cancellation, rebooking and no-show

C.7.1 The customer may cancel a booking free of charge up to 72 hours before the agreed start, unless a different cancellation deadline is stated in the service description, in the individual offer or in the booking confirmation.

C.7.2 Cancellation is made via the cancellation function of the online booking system, where the booking confirmation offers one, or by e-mail to office@halevipartner.com. The time of receipt by Halevi is decisive.

C.7.3 In the case of a later cancellation and in the case of a no-show, the agreed fee remains payable. Halevi credits what it saves as a result of the service not being provided or what it receives by allocating the slot elsewhere.

C.7.4 If the number of participants in a group booking is reduced within the cancellation period, the fee for the number of participants booked remains payable; the second sentence of C.7.3 applies accordingly.

C.7.5 The customer may nominate a replacement person who meets the participation requirements up until the start of the session. In that case no cancellation fee is charged.

C.7.6 Rebooking to another date is possible free of charge up to 72 hours before the start, subject to availability. Later rebooking requests are treated as a cancellation under C.7.3; Halevi may offer an alternative date as a gesture of goodwill in individual cases.

C.7.7 A time slot is reserved for every booking. If the customer arrives late, the session is not extended and the agreed fee must be paid in full. If the safety briefing has already taken place, Halevi may exclude late participants for safety reasons; C.7.3 then applies accordingly.

C.7.8 If a participant cannot take part because they do not meet a requirement under C.10, for example because they do not present identification, are impaired, do not meet the minimum age or refuse to sign, this is treated as a no-show under C.7.3.

C.7.9 If a date was booked with a voucher and was not cancelled in time under C.7.1 or was not used, the voucher is deemed redeemed to the extent of the service booked.

C.8 Cancellation and changes by Halevi

C.8.1 Halevi may cancel or postpone a date where there is an objective reason, in particular if:

- the stated minimum number of participants is not reached,

- the trainer falls ill or is otherwise unavailable and no equivalent replacement is available,

- there is a technical fault or a safety defect in the facility,

- an official order, force majeure or other circumstances do not permit the session to be held safely.

C.8.2 Halevi informs the customer as early as possible. The customer may choose an alternative date or receives a full refund of amounts already paid. Further claims exist only in accordance with C.12.

C.8.3 Minor and objectively justified changes are reasonable for the customer to accept, for example a change of trainer, the adaptation of individual exercises to the level of the group, or changes made for safety reasons.

C.8.4 Halevi may withdraw from the contract or exclude participants where there is good cause relating to the customer or the participant, in particular in the case of false statements, a weapons ban, a breach of the House Rules or justified safety concerns. In these cases the fee remains payable under C.7.3.

C.9 Vouchers

C.9.1 Vouchers are issued on request to office@halevipartner.com. They are made out for a specific service or for a monetary amount and are transferable.

C.9.2 Vouchers are valid for three years from the date of issue. After that period, the amount paid for the voucher is credited against a service provided by Halevi at the prices then applicable, until the statutory limitation period expires.

C.9.3 Redemption is only possible once an appointment has been arranged. C.7 and C.10 apply to the agreed date. Payment in cash is excluded, except in the case of withdrawal under C.5.2. Any unused residual value of a monetary voucher remains available as credit.

C.10 Participation requirements

C.10.1 Signature. Every participant, including every accompanying person, reads this document before their first activity in the facility and confirms it with their signature (also digitally, Part D.2). Without a signature, participation is not possible. Confirmation when booking online (Part D.1) does not replace the signature on site. Halevi may require a new signature, in particular where these terms have changed.

C.10.2 Identification and documents. Every participant carries a valid official photo ID. Anyone using the shooting range as the holder of a firearms authorisation additionally carries their valid firearms document. The documents must be presented on request.

C.10.3 Minimum age. The minimum age for all activities is 18, unless a lower minimum age is expressly stated for a particular offer. Persons under 16 may not enter the shooting ranges under any circumstances. Minors may take part only with the consent and signature of a legal guardian.

C.10.4 Sobriety. Participants must not be under the influence of alcohol, narcotics, medication or other substances that impair their attention, their judgement or their reactions. Anyone who has been drinking does not shoot and does not train.

C.10.5 Health. Every participant confirms that they are physically and mentally able to take part in the activity booked. Anyone with health conditions that may be relevant to their safety or physical capacity, such as cardiovascular disease, seizure disorders, recent injuries or pregnancy, obtains medical clearance beforehand and informs the trainer before the start.

C.10.6 No weapons ban. The participant must not be subject to a weapons ban or a provisional weapons ban.

C.10.7 Clothing. Participants wear the clothing stated in the service description and, in any event, sturdy, non-slip shoes. For shooting activities, high-necked upper clothing is recommended because of hot cases.

C.10.8 Punctuality. Participants arrive in good time so that registration and the safety briefing can be completed before the agreed start.

C.11 Special provisions for individual services

C.11.1 Use of the shooting ranges by holders of a firearms authorisation.

- A valid Austrian firearms possession certificate (Waffenbesitzkarte) or a valid firearms carry permit (Waffenpass) is required. Exceptions are possible only by arrangement with the range management.

- A person holding a firearms authorisation may bring one person without a firearms authorisation along to shoot, provided they have held the firearms authorisation for at least 12 months. The accompanying person also signs this document.

- Responsibility for the safety of the accompanying person and their constant supervision lies with the person holding the firearms authorisation.

- Spectators are not admitted to the shooting ranges.

- A booking of a static lane or of the dynamic shooting range applies to the time slot booked.

C.11.2 Adventure Shooting. Adventure Shooting (Erlebnisschießen) is aimed at persons without a firearms authorisation and serves to introduce them to firearms, weapon systems and shooting techniques under the guidance of instructors. It is not a course or formal training. What is learned and demonstrated is to be understood as an experience; any application outside the session is at the participant’s own responsibility and risk. The session does not constitute a confirmation within the meaning of Section 5(1) of the 2nd Weapons Act Implementing Regulation (2. Waffengesetz-Durchführungsverordnung, 2. WaffV).

C.11.3 Courses, training, workshops and trainer sessions. Any prior knowledge, authorisations or equipment required are set out in the service description. If a participant evidently does not meet them, the trainer may exclude them from individual exercises or from the session for safety reasons; C.7.8 applies accordingly. Certificates of attendance or evidence for authorities are issued only where this is expressly stated in the service description. Application of what has been learned outside the session is at the participant’s own responsibility.

C.11.4 Self-defence, Krav Maga and force-on-force training. These forms of training involve physical contact and physical exertion. The necessary protective equipment is provided by Halevi to the extent stated in the service description. The rules in Part A.7 apply.

C.11.5 Corporate events and closed groups. Content, schedule, price and cancellation conditions are governed by the individual offer; these terms apply in addition. Photographs and video recordings by participants are permitted only by prior arrangement with Halevi.

C.11.6 Sessions away from the facility. During exercises in public spaces, participants observe traffic regulations and public order and follow the instructions of the trainers.

C.12 Liability of Halevi

C.12.1 Halevi is liable for personal injury (injury to life, body or health) in accordance with statutory provisions. This liability is not limited.

C.12.2 For all other damage, in particular damage to property and financial loss, Halevi is liable only in cases of intent or gross negligence. Liability for slight negligence is excluded for such damage.

C.12.3 C.12.1 and C.12.2 also apply to employees, trainers and other vicarious agents of Halevi.

C.12.4 Halevi is liable for damage caused by other participants or by third parties only to the extent that Halevi is itself at fault.

C.12.5 Halevi does not assume safekeeping of items brought along, such as clothing, valuables, firearms or equipment, unless this is expressly agreed. Halevi is liable for their loss, theft or damage, and for the soiling or damage of training clothing in the course of training, in accordance with C.12.2.

C.13 Liability of customers and participants

C.13.1 Every participant is liable for damage to persons, to the facility and to property of Halevi or of third parties that they culpably cause, in particular through their handling of the firearm and through every shot they fire.

C.13.2 For hits outside the target and the backstop, the following flat rates are charged: ceiling, wall or floor shot EUR 38.00, light fitting EUR 96.00. Other damage is charged according to the actual cost.

C.13.3 Anyone bringing an accompanying person under C.11.1 is also liable for damage resulting from a breach of their duty of supervision.

C.13.4 If a shooting range is not left in a proper and clean condition (A.1.6), the cleaning effort is charged. Loaned equipment must be handled with care; compensation is charged for culpably caused loss or damage.

C.14 Data protection, video surveillance and recordings

C.14.1 Halevi processes personal data in accordance with its privacy policy, available at https://halevipartner.com/privacy-policy.

C.14.2 When booking and when registering on site, Halevi collects in particular name, date of birth, contact details, the number of the ID or firearms document, and the signature. This data is used for performing the contract, for verifying identity, age and authorisation, and as evidence that the participant has taken note of these terms and of the safety rules.

C.14.3 The facility is under video surveillance in order to protect persons and property and to ensure the safety of shooting operations.

C.14.4 Halevi uses photographs and video recordings of participants for advertising purposes only with separate consent. Participants may take photographs or film in the shooting and training areas only with Halevi’s consent, and may record other persons only with their agreement.

C.14.5 Participants receive information by e-mail (newsletter) only with separate consent, which can be withdrawn at any time.

C.15 Amendments to these terms

C.15.1 The version of these terms published on the website at the time the contract is concluded applies to each contract. Amendments apply to contracts already concluded only with the customer’s consent.

C.15.2 The safety and conduct rules of the House Rules (Part A) apply during a visit in the version published on the website and posted in the facility at that time.

C.16 Final provisions

C.16.1 Austrian law applies, excluding its conflict-of-law rules. Mandatory protective provisions of the state in which a consumer has their habitual residence remain unaffected.

C.16.2 For disputes with entrepreneurs, the court with subject-matter jurisdiction in Vienna has exclusive jurisdiction. The statutory places of jurisdiction apply to consumers; where a consumer has their domicile or habitual residence in Austria, or is employed in Austria, Halevi may bring proceedings against them only before the court having jurisdiction under Section 14 KSchG.

C.16.3 Should individual provisions be invalid, the validity of the remaining provisions remains unaffected. Vis-à-vis entrepreneurs, the invalid provision is replaced by a valid provision that comes closest to its economic purpose.
